Terms and Conditions

1. Who we are

OneTake is a trading name of Morgan Industries Ltd, a company registered in England and Wales with company number 17445665. Registered office: 140 Dance Square, London EC1V 3AL, United Kingdom. Email: admin@onetake.digital. We are not VAT registered. Payments are taken through Stripe's Managed Payments service, under which Onelink (formerly Link), a Stripe company, is the seller of record for each payment and accounts for any tax that applies; see section 18. The studio itself, and the rest of these terms, are between you and us. In these terms "we", "us" and "OneTake" mean that business, and "you" means the person or business holding the account.

2. These terms and how you accept them

These terms, together with our Privacy Policy and Cookie Notice, are the contract between you and us for the OneTake website and studio. You accept them by creating an account, and again by ticking the box when you buy a membership or top up. If you do not agree, please do not use OneTake.

You must be at least 18 years old. If you use OneTake for a business, you confirm you have authority to bind that business, and section 15 also applies to you.

3. Your account

4. Membership

5. Your balance and what things cost

6. Your right to cancel within 14 days

If you are a consumer in the United Kingdom or the European Union you have a legal right to cancel a purchase within 14 days without giving a reason. Here is how it works with OneTake.

These rights are in addition to the cancellation and refund promises in sections 4 and 5, and to your statutory rights in section 13.

7. The service, and what we do and do not promise

8. Your content and your videos

9. Acceptable use

You must not use OneTake to create, request or distribute content that:

You must also not attempt to extract, download or reuse our actors, voices, locations or props outside a video made in OneTake; reverse engineer, scrape or overload the service; share your account; or use automated tools against the studio without our written permission. Our providers apply their own content filters and may refuse a build; a refusal is not charged.

If someone tells us a video made in OneTake depicts them without consent or otherwise breaks these rules, we may remove it from our systems and suspend the account while we look into it.

10. Labelling AI content

Every video made in OneTake is realistic synthetic video of a synthetic presenter. When you publish it you must follow the rules of the platform you post to and the law where your audience is. In particular:

Labelling is your responsibility as the publisher. We help by keeping provenance data intact and by reminding you at download.

11. Our libraries: actors, voices, locations and props

12. Suspension and closing accounts

13. Your statutory rights

If you are a consumer, nothing in these terms takes away rights you have under the law of the country you live in. In the United Kingdom, the Consumer Rights Act 2015 says digital content must be of satisfactory quality, fit for purpose and as described, and services must be carried out with reasonable care and skill; if they are not, you are entitled to a repair or replacement, a price reduction or, in some cases, a refund. In the European Union, equivalent rights apply under the Digital Content Directive. For advice in the UK contact Citizens Advice.

14. Our liability to you

15. Business users

If you use OneTake in the course of a business, in addition to the rest of these terms: you will indemnify us against claims, losses and costs arising from your content, your inputs, your failure to obtain consents and any breach of section 9 by you or anyone using your account; we exclude liability for loss of profit, revenue, business, goodwill or data and for indirect or consequential loss; and our total liability in any 12-month period is limited to the amounts you paid us in that period. Sections 6 and 13 apply only to consumers.

16. Changes to these terms

We may update these terms to reflect changes in the law, in our providers or in the studio. We will post the new version here with a new date and email account holders at least 30 days before any change that reduces your rights or increases your obligations takes effect. If you do not accept a change, cancel before it applies and the old terms cover the rest of your paid month.

17. Law and disputes

These terms are governed by the law of England and Wales, and you can bring a claim in the courts of England and Wales. If you live in Scotland or Northern Ireland you may also bring a claim in your local courts. If you live in the European Union, you keep the protection of the mandatory consumer laws of your own country and may bring a claim in its courts. If you have a complaint, please email us first; we will do our best to resolve it within 14 days.
